Donaldson & Guin was successful in its efforts to obtain an Order from Jefferson County Circuit Judge Michael Graffeo requiring the County to pay accrued interest in the County's Redemption Fund to County taxpayers who had redeemed their property.
During May of each year, the Jefferson County Tax Collector conducts tax sales to collect unpaid property taxes. When purchasers at tax sales pay more than the amount owed to the taxing authorities, the excess funds are placed in the Redemption Fund and invested at interest. When taxpayers redeem their properties, the excess funds are returned to the tax sale purchasers.
Donaldson & Guin successfully sued to force Jefferson County to pay $5.4 million of accrued interest in the Redemption Fund to taxpayers who had redeemed their properties. During July, 2008, the Jefferson County Treasurer more than 11,000 checks to county taxpayers.
